1. Acceptance of Terms

By accessing or using Send Rewards ("the Platform"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Platform.

2. Description of Service

Send Rewards is a voucher campaign and SMS rewards platform that enables agencies and brands to create, manage, and distribute digital vouchers and reward notifications to their customers via SMS and campaign landing pages.

3. Account Registration

Access to the Platform is by invitation only. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

4. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of applicable regulations
• Send unsolicited or spam SMS messages through the Platform
• Attempt to gain unauthorised access to other accounts or systems
• Interfere with or disrupt the Platform's infrastructure
• Upload or distribute malicious content, including voucher codes obtained fraudulently
• Exceed rate limits or abuse the API in a manner that degrades service for others

5. Campaign Content

You are solely responsible for the content of your campaigns, including SMS messages, landing page text, voucher codes, and any associated materials. Campaigns must comply with all applicable consumer protection, advertising, and data privacy laws in the jurisdictions where your campaigns operate.

6. SMS Usage

SMS messages sent through the Platform are subject to delivery by third-party gateways. We do not guarantee delivery of every message. SMS credits are consumed upon sending and are non-refundable for messages that fail due to invalid phone numbers or recipient-side issues.

7. Vouchers

You are responsible for sourcing and uploading valid voucher codes. The Platform facilitates distribution but does not guarantee the validity, value, or redeemability of voucher codes. Voucher expiry and terms are determined by the campaign creator.

8. Data Protection

Your use of the Platform is also governed by our Privacy Policy. As a campaign operator, you act as a data controller for participant data collected through your campaigns. You must ensure you have appropriate legal bases for collecting and processing participant data.

9. Intellectual Property

The Platform, including its design, code, and branding, is owned by us and protected by intellectual property laws. You retain ownership of your campaign content. By using the Platform, you grant us a limited licence to host and display your content as necessary to provide the service.

10. Limitation of Liability

The Platform is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of revenue, data, or business opportunities.

11. Termination

We reserve the right to suspend or terminate your access to the Platform at any time for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately.

12. Changes to These Terms

We may modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of South Africa.
